Welcome to SmartWallet. These Terms of Service (“Terms”) govern your access to and use of the SmartWallet website, mobile applications, and all related services (collectively, the “Platform”). By accessing or using SmartWallet, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our services.

1. Eligibility

To use SmartWallet, you must:
* Be at least 18 years old (or the legal age in your jurisdiction).
* Have the legal capacity to enter into a binding contract.
* Not be located in or a resident of any jurisdiction where the use of our services is prohibited by law.

2. Services Provided

SmartWallet offers:
* A secure, self-custody crypto wallet.
* Buy, sell, send, and receive functionality for supported cryptocurrencies.
* Access to decentralized and Web3 tools.
* Optional integration with third-party providers for fiat conversions and other services.

3. Account Registration & Security

* You are solely responsible for securing your wallet, including managing your private keys, recovery phrases, and passwords.
* SmartWallet is a non-custodial wallet; we do not store or have access to your private keys.
* We do not require Know Your Customer (KYC) unless mandated by law in your jurisdiction or by third-party services you choose to integrate with.

4. Privacy & Data

* We do not collect or store personal data unless required for specific optional features or legal compliance.
* No trackers or third-party ads are embedded in the Platform.

5. User Conduct

By using SmartWallet, you agree to:
* Use the Platform only for lawful purposes.
* Not engage in illegal or prohibited activities, including fraud, money laundering, terrorist financing, or the distribution of illegal content.

6. Fees

* Transaction fees (network/gas fees) may apply and are clearly disclosed at the time of transaction.
* SmartWallet may charge service fees for certain operations. All fees will be transparently displayed before confirmation.

7. Third-Party Services

* SmartWallet may integrate with third-party services (e.g., exchanges, fiat gateways).
* Your use of these services is subject to their own terms and policies.
* We are not responsible for any issues, losses, or liabilities arising from third-party providers.

8. Risk Disclosure

* Cryptocurrency markets are volatile and involve significant risk.
* You are solely responsible for your investment decisions and wallet security.
* SmartWallet does not provide financial, investment, or legal advice.

9. Limitation of Liability

To the maximum extent permitted by law:
* SmartWallet is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Platform.
* We are not responsible for lost funds, passwords, or private keys.

We reserve the right to suspend or terminate your access to the Platform at any time, with or without notice, for violating these Terms or for security concerns.
